Chibi Comme - Terms of Use

The following document sets out the terms of use for all Chibi Comme Services.

Before using any of our Services, you are required to read, understand, and agree to these terms.

When we say “Services” in these terms, we mean Chibi Comme services, websites.

Acceptance of Terms

In these terms, when we say “you” or “your,” we mean you. If you’re accessing our Services on behalf of a legal entity (like your employer), you hereby agree and represent to us that you have the authority to bind that entity to these terms, and “you” and “your” will refer to that entity.

IMPORTANT NOTE: By using the Services, you are agreeing, on behalf of yourself and those you represent, to comply with and be legally bound by these terms as well as our and all applicable laws.

User Requirements / Prohibited Conduct

The following types of conduct are prohibited.

  • Do not post content that violates our User Content rules.

  • Do not do anything illegal.

  • Do not attempt to gain unauthorized access to Chibi Comme systems, data, or user accounts

  • Do not encourage or promote violations of these rules by others.

  • Do not engage in any predatory behavior with minors, including attempting to befriend a child in order to manipulate and exploit them (i.e., grooming), engaging in sexual conversation with or soliciting sexual material from minors.

  • Do not promote terrorism or political violence, or advocate, recruit, or fundraise for terrorist organizations or organizations that promote political violence.

  • Do not depict, glorify, of encourage suicide. If you are concerned about a user’s mental health please contact support@synculab.com

  • Do not attempt to explore, scan, or circumvent any Platform features or security measures on the site,

  • Do not attempt to interfere, disrupt, or create an undue burden on any Chibi Comme or user computer, host, or network including, without limitation, by submitting malicious code, overflowing, “flooding”, “mail-bombing,” or “crashing”.

  • Using the Site for recording, processing, or mining information about other users.

  • Do not display any unauthorized commercial advertisements.

  • No offensive, hateful, or illegal content

    • Content that is pornographic, excessively violent, abusive, or threatening in any way;

    • Is offensive or promotes or otherwise incites racism, bigotry, hatred or physical harm of any kind against any group or individual;

    • Encourages or advocates for conduct that could be as a criminal offense, or otherwise violate any law

  • No creating a security/privacy risk to others

    • Content that contains information that causes or creates a privacy or security risk to any person;

  • No content that is stolen from others or infringes the intellectual property rights of others.

Our services are not directed to children under the age of 13, and you must confirm that you are 13 years or older to create an account and use the Services. If we have actual knowledge that you are under the age of 13 (or the minimum age at which a person may use the Services in your state, province, or country without parental consent, if greater), we will cease providing Services to you and delete your account and your data. We may offer additional Services with additional terms that may require you to be even older to use them. So please read all such terms carefully.

Service Termination

These Terms are effective until terminated by Chibi Comme or you. Chibi Comme, in its sole discretion, has the right to terminate these Terms and/or your access to the Services, or any part thereof, immediately at any time and with or without cause (including, without any limitation, for a breach of these Terms). Chibi Comme shall not be liable to you or any third party for termination of the Services, or any part thereof.

The Service may suspend or discontinue the provision of all or part of the Service without prior notice to the User if the Service determines that any of the following reasons exist.

  1. to perform maintenance checks or updates of the computer system related to this service.

  2. when it is difficult to provide the Services due to force majeure such as earthquakes, lightning strikes, fires, power outages, or natural disasters.

  3. when computers or communication lines are down due to an accident.

  4. in other cases where the Service deems it difficult to provide the Service.

 

Intellectual Property

You agree to abide by laws regarding copyright, trademark, patent, and trade secret ownership and use of intellectual property, and you shall be solely responsible for any violations of any laws and for any infringements of any intellectual property rights caused by any content you provide, post, or transmit, or that is provided or transmitted using your user name or user ID.

User Termination

Subject to applicable law, we reserve the right to suspend or terminate your account and/or your access to some or all of our services with or without notice, at our discretion, including if:

  • You breach these terms, any Chibi Comme policy, or additional terms that apply to specific products;

  • We’re required to do so to comply with a legal requirement or court order;

  • We reasonably believe termination is necessary to prevent harm to you, us, other users, or third parties.

However, we will give you advance notice if required by applicable law.

In order to use some of the services of the Site you may have to create an account ('Account'). You agree not to create an Account for anyone else or use the account of another without their permission. When creating your Account, you must provide accurate and complete information. You are solely responsible for the activity that occurs in your Account, and you must keep your Account password secure. You must notify Chibi Comme immediately of any breach of security or unauthorized use of your Account. As between you and Chibi Comme, you are solely responsible and liable for the activity that occurs in connection with your Account. If you wish to delete your Account you may do it from the setting page on the deck.

Warranty Disclaimers

  • This section applies whether or not the services provided under the Services are for payment. Applicable law may not allow the exclusion of certain warranties, so to that extent certain exclusions set forth herein may not apply.

  • THE SERVICES ARE PROVIDED ON AN AS IS AND AS AVAILABLE BASIS, AND WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED. CHIBI COMME HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND THOSE ARISING BY STATUTE OR FROM A COURSE OF DEALING OR USAGE OF TRADE. CHIBI COMME DOES NOT GUARANTEE THAT THE SERVICES WILL BE FREE OF BUGS, SECURITY BREACHES, OR VIRUS ATTACKS. THE SERVICES MAY OCCASIONALLY BE UNAVAILABLE FOR ROUTINE MAINTENANCE, UPGRADING, OR OTHER REASONS. YOU AGREE THAT CHIBI COMME WILL NOT BE HELD RESPONSIBLE FOR ANY CONSEQUENCES TO YOU OR ANY THIRD PARTY THAT MAY RESULT FROM TECHNICAL PROBLEMS OF THE INTERNET, SLOW CONNECTIONS, TRAFFIC CONGESTION OR OVERLOAD OF OUR OR OTHER SERVERS. WE DO NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT, PRODUCT, OR SERVICE THAT IS FEATURED OR ADVERTISED ON THE SERVICES BY A THIRD PARTY.

  • CHIBI COMME DOES NOT WARRANT, ENDORSE OR GUARANTEE ANY CONTENT THAT APPEARS IN A USER SUBMISSION, AND DOES NOT MAKE ANY REPRESENTATION OR WARRANTY WITH RESPECT TO, AND DISCLAIMS ALL LIABILITY FOR, ANY SUCH CONTENT.

  • YOU SPECIFICALLY ACKNOWLEDGE THAT CHIBI COMME SHALL NOT BE RESPONSIBLE FOR THE USER SUBMISSIONS OR CONDUCT (INCLUDING DEFAMATORY, OFFENSIVE, ILLEGAL, OR NEGLIGENT CONDUCT) OF ANY SERVICES USER AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

  • EXCEPT AS EXPRESSLY STATED IN OUR PRIVACY POLICY, CHIBI COMME DOES NOT MAKE ANY REPRESENTATIONS, WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE SECURITY OF ANY INFORMATION YOU MAY PROVIDE OR ACTIVITIES YOU ENGAGE IN DURING THE COURSE OF YOUR USE OF THE SERVICES.
     

Services May Change

We may add or remove features, start new services, or limit or discontinue existing services. While we try to minimize disruptions, we cannot guarantee that there will not be an outage, planned downtime, or change to the services, and your content may not be retrievable due to such outages or changes. We are not liable for any such outages, planned downtime, or service changes.

Payments to Chibi Comme

Except as expressly set forth in the Terms, your general right to access and use the Site is currently for free, but Chibi Comme may in the future charge a fee for certain access or usage. You will not be charged for any such access or use of the Site unless you first agree to such charges, but please be aware that any failure to pay applicable charges may result in you not having access to some or all of the Site.

Third-party services purchased via the Services may be subject to different refund policies that those third-party services determine, and they may be non-refundable. The purchase terms and conditions for such third-party services may be displayed during the purchase process, such as through a link to the purchase terms and conditions. It's your responsibility to verify your ability to purchase, cancel or obtain a refund for a third-party service.. Unless otherwise stated in this Agreement, we don’t offer refunds for purchases of third-party services. The terms for refunding items that have already been paid for follow the terms of the store where the item was purchased.(Smartstore, Artmug, Booth, Fiverr)

INTEGRATIONS AND THIRD PARTY CLIENTS

We integrate with third-party software and is used on third-party clients to provide a full suite of functionalities to our users. We are not responsible for any issues or loss arising from the use of any third-party software. Your access and use of the third-party software is governed by the terms of service or user agreements of that software.

Modification

We reserve the right, at our discretion, to change these Terms without notice at any time. Your continued use of the Services thereafter means that you accept those changes. We may change these Terms without your separate consent if we determines that

  1. the modification of these Terms of Use is in the general interest of the user; 2. the modification is not contrary to the purpose of the Service Agreement

  2. the modification of this Agreement is not contrary to the purpose of this Service Agreement, and is reasonable in light of the necessity of the modification, the reasonableness of the content after the modification, and other circumstances pertaining to the modification;

  3. the Administrator shall notify the User in advance of the modification of the Terms of Use in accordance with the preceding paragraph, the contents of the modified Terms of Use, and the effective date of the modification.
     

Privacy

We will use any personal information that we may collect or obtain in connection with the Services in accordance with our privacy policy which is available at Privacy policy. You agree that we may use personal information that you provide or make available to us in accordance with the Privacy Policy.

Assignment

These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by Chibi Comme without restriction or notification to you. Any prohibited assignment shall be null and void.

Governing Law

Unless otherwise specified in writing, these Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, and any dispute with the Company shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the address of the user at the time of filing the complaint, and if there is no address, the district court having jurisdiction over the user's residence. Provided, however, that if the address or residence of the user is not clear at the time of filing the complaint, the competent court shall be determined in accordance with the Civil Procedure Act.
